PEPPERFIT TERMS AND CONDITIONS

  1. ABOUT THESE TERMS

These Terms and Conditions apply when you use pepperfit.com or purchase products from Pepperfit.

Please read them before placing an order.

By placing an order, you agree to these Terms and Conditions together with any policies referred to within them.

Nothing in these Terms and Conditions limits or removes any rights you have under applicable consumer law.

In these Terms and Conditions, “Pepperfit”, “we”, “us” and “our” refer to The Basilverse Limited trading as Pepperfit.

“You” and “your” refer to the person using the website or purchasing from us.

  1. OUR WEBSITE AND SHOPIFY

The customer-facing Pepperfit website is provided using Lovable.

Our product catalogue, basket, checkout, payment processing and order-management services are provided through Shopify.

When you proceed to checkout, you may be transferred to a secure Shopify-hosted checkout page.

Your use of Shopify’s services may also be subject to Shopify’s applicable terms and privacy information.

  1. WHO MAY PLACE AN ORDER

You must be at least 18 years old and legally capable of entering into a binding contract to place an order.

Products may have their own age, pregnancy, health or suitability guidance. The person placing the order is responsible for reviewing the information provided on the product page and packaging before the product is used.

  1. PRODUCT INFORMATION

We take reasonable care to describe and display our products accurately.

Product information may include:

• the product name and format
• size or volume
• ingredients
• directions for use
• suitability and precautions
• price
• stock availability
• product photographs

Because natural ingredients and raw materials can vary, there may be small differences in colour, aroma, texture or appearance between batches. These natural variations do not necessarily indicate that a product is faulty.

Product images are provided for illustration. Screen settings, lighting and photography may affect how colours and packaging appear.

Packaging, labels and product presentation may be updated from time to time. The product supplied may therefore differ slightly from an earlier photograph where the formulation, required information or packaging has been updated.

We may correct product information where an error is identified.

  1. AROMATHERAPY AND PRODUCT GUIDANCE

Pepperfit products are cosmetic and aromatherapy products intended for external use unless the individual product information expressly states otherwise.

Information on the website, in the Pepperfit Journal or elsewhere in our communications is provided for general information and product-use guidance.

It is not medical advice and is not intended to diagnose, treat, cure or prevent any disease or medical condition.

You should:

• follow the instructions and precautions supplied with the individual product
• review the full ingredient list if you have known allergies or sensitivities
• seek appropriate professional advice if you are pregnant, breastfeeding, taking medication, under medical supervision or managing a relevant health condition
• stop using a product if irritation or an adverse reaction occurs

Suitability differs between products and blends. Do not assume that guidance applying to one Pepperfit product applies to another.

  1. PRICES

Prices are shown in pounds sterling unless another currency is clearly displayed.

The price charged will be the price shown at checkout when you place your order, subject to correction of any obvious pricing error.

Any applicable taxes will be displayed or calculated through Shopify checkout.

Delivery charges are shown separately where applicable.

We may change prices at any time, but a price change will not affect an order already accepted by us.

  1. PROMOTIONS AND DISCOUNT CODES

Promotions and discount codes are subject to any terms stated with the offer.

Unless we state otherwise:

• discount codes cannot be exchanged for cash
• only one discount code may be used per order
• discount codes cannot normally be applied after an order has been placed
• excluded products, customer groups or minimum-order values may apply
• promotions may be withdrawn or amended before an order is placed

A discount code does not guarantee that a product will remain available.

  1. FREE UK SHIPPING

Where advertised, free UK shipping applies only to eligible UK orders meeting the stated order value.

The current qualifying amount and any exclusions will be shown on the website or at checkout.

Free shipping does not apply automatically to international orders.

  1. PLACING AN ORDER

You can select products, quantities and available variants before adding them to your basket.

Please check your basket carefully before proceeding to checkout.

You are responsible for providing complete and accurate:

• contact details
• billing information
• delivery information
• product and variant selections

The checkout process will show the products selected, prices, available delivery options and the amount payable.

Selecting the final payment button places an order with an obligation to pay.

After placing an order, you should receive an electronic acknowledgement or confirmation.

  1. WHEN A CONTRACT IS FORMED

The website presentation and product listings are invitations to place an order. They are not, by themselves, our acceptance of an order.

Your order is an offer to purchase the selected products.

A binding contract is formed when we send confirmation that your order has been accepted, or when we dispatch the order, depending on the wording of the confirmation you receive.

An automated order acknowledgement does not necessarily mean that the order has been accepted.

  1. OUR RIGHT TO REFUSE OR CANCEL AN ORDER

We may refuse or cancel an order before dispatch where there is a reasonable reason to do so, including where:

• a product is unavailable
• payment is not authorised
• the delivery address cannot be served
• the order appears fraudulent or unauthorised
• a pricing or product-information error is obvious
• an order appears to be intended for unauthorised resale
• a customer has attempted to misuse a promotion or discount
• fulfilling the order would breach a legal or regulatory requirement

Where payment has already been taken for an order we cannot fulfil, we will arrange a refund.

We will try to contact you using the details supplied with the order.

  1. PAYMENT

Payment is processed through the payment options available at Shopify checkout.

You confirm that you are authorised to use the selected payment method.

We do not normally receive or store your complete payment-card details.

Payment providers may carry out security, verification and fraud-prevention checks.

An order may be delayed or declined if a payment cannot be authorised or verified.

  1. AVAILABILITY

Products and variants are subject to availability.

Adding a product to your basket does not reserve it.

Although stock information is updated through Shopify, a product may occasionally become unavailable after an order is placed.

Where this happens, we will contact you and offer an appropriate option, which may include:

• dispatching the available items
• waiting for replacement stock where agreed
• choosing an alternative product
• cancelling the unavailable item
• cancelling the order

Any refund due will be issued to the original payment method.

  1. DELIVERY

Delivery options and charges are displayed on the Shipping page or at checkout.

We will send orders to the delivery address supplied during checkout.

You are responsible for checking that the address is complete and accurate.

We will aim to dispatch and deliver orders within the times stated, but delivery estimates are not guaranteed unless we expressly agree a fixed delivery date.

Unless another timeframe is agreed, goods will normally be delivered within 30 days of the order being accepted.

Delivery may be affected by circumstances outside our reasonable control, including postal disruption, severe weather, transport delays, customs procedures or incorrect delivery information.

Please contact info@pepperfit.com if an order has not arrived within the expected timeframe.

  1. INTERNATIONAL ORDERS

Where international delivery is available, the customer is responsible for ensuring that the products can lawfully be imported and used in the destination country.

International orders may be subject to:

• customs procedures
• import taxes
• duties
• handling charges
• local restrictions
• delivery delays

Unless checkout expressly states otherwise, duties and import charges are the responsibility of the recipient.

Pepperfit is not responsible for a destination country refusing, delaying or charging for an imported order where this arises from local laws or customs procedures.

  1. CANCELLING AN ORDER

Please contact info@pepperfit.com as soon as possible if you wish to cancel an order.

Where the order has not been dispatched, we will try to cancel it before shipment.

Where it has already been dispatched, you may need to follow the returns procedure.

Your cancellation and return rights are explained in our Returns and Refund Policy.

  1. RETURNS AND REFUNDS

Returns, cancellations and refunds are handled according to our Returns and Refund Policy and applicable consumer law.

For most products purchased online, consumers have a limited period in which they may notify us that they wish to cancel.

Certain sealed products may be excluded from change-of-mind returns after opening where they are not suitable for return for health-protection or hygiene reasons.

This exclusion does not remove your rights where a product is faulty, damaged, misdescribed or otherwise does not meet applicable legal requirements.

Please contact info@pepperfit.com before returning a product. We will provide the return instructions and address by email.

  1. FAULTY, DAMAGED OR INCORRECT PRODUCTS

Products must be:

• of satisfactory quality
• fit for their usual purpose
• as described

Please contact info@pepperfit.com if a product arrives faulty, damaged, incorrect or not as described.

Include your order number and any useful photographs.

Depending on the circumstances and your legal rights, the appropriate remedy may include:

• a refund
• a replacement
• another suitable resolution

Nothing in these Terms and Conditions limits your statutory rights.

  1. OWNERSHIP AND RISK

Risk in the products passes to you when they are delivered to you or to a person identified by you to receive them.

Ownership passes to you when we have received full payment and the products have been delivered.

  1. CUSTOMER ACCOUNTS

Where customer-account facilities are available, you are responsible for:

• providing accurate information
• keeping login details confidential
• taking reasonable steps to protect your account
• notifying us of suspected unauthorised access

We may suspend an account where reasonably necessary to protect the customer, the business or the website.

  1. REVIEWS AND CUSTOMER CONTENT

Where review or content-submission functions are available, you may submit genuine feedback about products you have used.

You must not submit content that:

• is false or deliberately misleading
• infringes another person’s intellectual-property or privacy rights
• contains personal or confidential information
• is unlawful, defamatory, abusive, threatening or discriminatory
• contains malicious code, spam or unrelated promotional material
• falsely claims an experience or purchase that did not occur

You retain ownership of content you create.

By submitting content for publication, you grant us a non-exclusive, royalty-free licence to display, reproduce and use that content for operating and promoting Pepperfit, subject to applicable law and our Privacy Policy.

We may moderate, reject or remove content where reasonably necessary, but we will not alter the substance of a genuine customer opinion.

  1. INTELLECTUAL PROPERTY

The website and its content may include:

• text
• product descriptions
• photographs
• graphics
• logos
• branding
• page designs
• articles
• downloadable material

This content is owned by or licensed to The Basilverse Limited and is protected by applicable intellectual-property laws.

You may view and use the website for personal, non-commercial purposes.

You must not reproduce, republish, distribute, sell, commercially exploit or create derivative works from our content without prior written permission, except where the law expressly permits it.

“Pepperfit”, its branding and associated visual identity may not be used in a way that suggests approval, partnership or endorsement without permission.

  1. ACCEPTABLE WEBSITE USE

You must not:

• use the website for an unlawful or fraudulent purpose
• interfere with its security or operation
• introduce viruses, malware or harmful code
• attempt unauthorised access to the website, accounts or connected systems
• scrape, harvest or collect information in a way that breaches applicable law
• misuse the checkout, discounts or payment systems
• impersonate another person
• submit false information
• infringe our rights or the rights of another person

We may restrict access where reasonably necessary to protect the website, customers or business.

  1. THIRD-PARTY SERVICES AND LINKS

The website may contain links to or integrations with services operated by other organisations, including Shopify, payment providers, delivery providers, review services and social-media platforms.

We are not responsible for the content or availability of independent third-party websites.

Third parties are responsible for their own terms, privacy practices and services.

Our inclusion of a link does not necessarily imply endorsement.

  1. WEBSITE AVAILABILITY

We aim to keep the website available and accurate, but we cannot guarantee that access will always be uninterrupted or error-free.

We may need to suspend or change parts of the website for maintenance, security, updates or circumstances outside our reasonable control.

We will take reasonable steps to correct material errors brought to our attention.

  1. OUR RESPONSIBILITY TO YOU

We are responsible for losses that are a foreseeable result of our breach of these Terms and Conditions or our failure to use reasonable care and skill.

We are not responsible for a loss that was not reasonably foreseeable when the contract was formed.

We do not exclude or limit liability where it would be unlawful to do so, including liability for:

• death or personal injury caused by negligence
• fraud or fraudulent misrepresentation
• breach of your statutory rights
• defective products where liability cannot legally be excluded
• any other liability that cannot be excluded under applicable law

We supply products for private consumer use unless a separate professional or trade agreement applies.

If you use consumer products for a commercial, professional or resale purpose without a separate agreement, we are not responsible for business losses such as lost profit, lost revenue, lost opportunity or business interruption, to the extent permitted by law.

  1. EVENTS OUTSIDE OUR CONTROL

We are not responsible for delay or failure caused by circumstances outside our reasonable control.

These may include:

• severe weather
• natural disasters
• fire
• epidemic or pandemic disruption
• industrial action
• transport or postal disruption
• interruption of utilities or communications
• cyberattack
• government action
• customs delays
• supplier failure that could not reasonably have been avoided

Where such an event affects an accepted order, we will take reasonable steps to minimise the effect and communicate with you.

Your legal rights remain unaffected.

Our use of personal information is explained in our Privacy Policy.

Our use of cookies and related technologies is explained in our Cookie Policy and through the website’s cookie controls.

  1. CHANGES TO THESE TERMS

We may update these Terms and Conditions where our services, processes, suppliers or legal responsibilities change.

The terms applying to an order will normally be those in force when the order was placed.

The latest version will be published on this page with its updated date.

  1. IF PART OF THESE TERMS IS INVALID

If a court or competent authority finds that one part of these Terms and Conditions is unlawful or unenforceable, the remaining provisions will continue to apply.

  1. DELAY IN ENFORCING THESE TERMS

If we do not immediately enforce a right under these Terms and Conditions, that does not mean we have waived that right.

  1. TRANSFER OF RIGHTS

We may transfer our rights and obligations under these Terms and Conditions as part of a sale, transfer or reorganisation of the business, provided this does not reduce your legal rights.

You may transfer your rights only where we agree in writing or where the law allows it.

These Terms and Conditions are between you and us.

Except where expressly stated, no other person has a right to enforce them.

  1. GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the United Kingdom, you may also benefit from mandatory protections available under the law applying where you live.

You may bring legal proceedings in the courts of England and Wales.

If you live in Scotland or Northern Ireland, you may also be entitled to bring proceedings in your local courts.
